Office furniture disposal and clearance: the rules and the paperwork

Clearance is the quiet half of an office move, and the half with legal paperwork attached.

Your duty of care

Anything a commercial activity produces is business waste. GOV.UK sets out the responsibilities plainly: keep waste to a minimum by preventing, reusing, recycling or recovering it in that order; sort and store it safely and securely; complete a waste transfer note for each load of waste that leaves your premises; check that your waste carrier is registered; and do not allow them to dispose of your waste illegally (gov.uk: dispose of business or commercial waste).

The waste transfer note

For each load of non-hazardous waste moved off your premises you need a waste transfer note or a document containing the same information, such as an invoice. Both your business and the business taking the waste must fill in the sections that apply, sign it, keep a paper or electronic copy for 2 years, and show it to an enforcement officer from the local council or the Environment Agency on request (gov.uk: waste transfer notes).

Where the same holder, carrier and waste type repeat, a season ticket can cover multiple transfers of non-hazardous waste for up to a year, supported by a schedule recording the date, time and quantity of each transfer. That is more useful for an ongoing service than for a one-off clearance, but it is worth knowing it exists.

Checking the carrier

Anyone who transports waste must be registered as a carrier, and GOV.UK states you can get an unlimited fine if you do not register. Registration is usually free where a business only transports waste it produces itself, and otherwise costs £191.02, with upper tier registrations renewed every 3 years for £130.25 (gov.uk: register as a waste carrier, broker or dealer). Registered organisations appear in the public register of waste carriers, brokers and dealers, so checking a clearance firm takes about a minute.

Reuse routes worth the effort

  • Resale. Task chairs and height-adjustable desks from recognised brands hold value; melamine desking generally does not.
  • Charity and community reuse. Slower to arrange and needs lead time, but it removes disposal cost and gets furniture out of the building intact.
  • Take it with you. The cheapest disposal is not disposing. Reusing existing desks in the new fit-out also shortens the clearance window on your last day in the old building.
  • Segregate early. Dry recyclables, WEEE and general waste leaving as one mixed load is the most expensive way to do it.

Book the clearance around the lease end, not around move day. Anything left in the building after handover becomes a dilapidations problem instead of a waste problem, and that is a more expensive category.
